For Project: Montenegro—Capacity Building and Improved Legal Harmonization, Performance and Efficiency within the Transport Sector
Our project strengthens Montenegro’s transport sector by enhancing institutional capacity, aligning national legislation with EU transport acquis, and advancing the preparation and implementation of priority transport projects.
The initiative focuses on improving strategic planning, legal harmonization in areas like road safety and maritime transport and developing priority infrastructure projects to a mature stage. These efforts contribute to creating a more efficient, sustainable, and EU-compliant transport system in Montenegro.
DAI is looking to recruit a Senior Non-Key Expert (SNKE) in Maritime Law for drafting the Law Amending Law on Rights of Passengers in Maritime and Inland Navigation

Overall objective:
In order to fulfil such a demanding harmonization agenda there is an urgent need for legislative drafting support, which entails efficient harmonization planning under the foreseen, tight EC deadlines. Every legislative instrument before going to the Montenegrin legislative procedure needs to be fully compliant not only with the respective part of the EU transport Acquis, but also with the rest of the Montenegrin structure of laws, and drafted in accordance with the Instruction on Instruments for harmonization of Montenegrin Law with the Acquis communautaire (Sl.l. CG, 15/2012).
Overall objective of this assignment is to close the remaining gaps in harmonization of MNE maritime legislation, especially that related to passengers’ rights in maritime and inland navigation, in order to eventually contribute to successfully closing Chapter 14 and reaching the CB3.
Specific objectives:
Outcome 1 of the assignment is drafting the Law Amending the Law on Passengers’ Rights in Maritime and Inland Navigation with Regulation 392/2009 on the liability of carriers in maritime passenger transport in case of accidents with the accompanying Table of Concordance.Outcome 2 of the assignment is knowledge transfer for the MoMA officers thus strengthening the administrative capacities within MoMA.Expected Outputs:

General scope of work under this short-term assignment is to draft Law Amending the Law on Passengers’ Rights in Maritime and Inland Navigation harmonized with Regulation 392/2009 on the liability of carriers in maritime passenger transport in case of accidents. This assignment will help final closing of the Closing Benchmark 3 with respect to maritime transport:
CB3: Montenegro aligns with the acquis on passenger rights in all modes of transport.

The SNKE have the following responsibilities under this assignment:
Prepare Draft Law Amending the Law on Passengers’ Rights in Maritime and Inland Navigation harmonized with Regulation 392/2009 on the liability of carriers in maritime passenger transport in case of accidents with accompanying Table of Concordance.Daily liaise with MoMA officers to enhance smooth enforcement and knowledge transfer of the legislation drafted.Any changes made to the specific provisions of the ToR of the project and the Contractor's offer regarding the performance of the above tasks shall be subject to agreement with the KE2, Team Leader, Contractor and project beneficiaries. An expert cannot propose or accept any changes or make any changes to project activities without the prior approval of KE2 and the Team Leader.
Required Qualifications and Experience:
Qualification: University degree (where a university degree has been awarded on completion of four years of study in a university or equivalent institution), and 5 years of experience in maritime law, in addition to those required under general professional experience (required)General professional experience: Minimum 10 years general professional experience (required)Specific professional experienceDirect experience in drafting or implementing maritime law (required)Experience in harmonization of transport laws under the TA or similar assistance projects (preferred)Language skills:Good knowledge of the English language (required)Knowledge of Montenegrin/Croatian/Serbian language (preferred)Additional assets: Computer literacy, incl. Start date: The implementation of this activity should start as soon as possible, upon approval by the EUD.
