Senior Contracts Engineer
Job Description: Senior Contracts Engineer 
Qualification BSc in Quantity Surveying, Engineering Discipline, or equivalent. Experience Minimum 10 years' experience in various stages of pre- and post-contract administration, with at least 5 years in the oil and gas industry. Proficient in commercial and contractual aspects of pre- and post-contract award administration. Possession of sound knowledge of Contracts Law is desirable. Proficient in contractual correspondence, contract verbatim, report writing, with strong analytical, logical, and problem-solving skills. Thorough understanding of engineering, procurement, and construction techniques, as well as other forms of contracts like FEED, ECS, Construction, Consultancy, and Operation & Maintenance (O&M) contracts and their related works/services. Knowledge of Incoterms and commercial implications. Computer literate and capable of using this knowledge for contract analysis and evaluation of statistical data, both historical and projected. Knowledge of SAP is preferred.
Primary Duties and Responsibilities Provide expertise and practical assistance to all assigned Sponsoring/End-User Departments in all tendering and contractual matters from project inception to contract close-out. Ensure efficient and effective implementation of purchasing processes and manage the procurement of materials and equipment for Category purchasing groups, from Purchase Requisition assignment to delivery and payment to suppliers. Review and advise at the project inception stage, considering best practices in tendering and contracting strategy. Prepare pre-qualification documents, invitations, and evaluation criteria in consultation with the Sponsoring Department (SD), and provide expert advice on shortlisting potential bidders. Suggest the most appropriate tendering process and prepare Tender Plan submissions along with the Tender strategy. Review and comment on the Scopes of Work/Services (SOW). Identify contractual gaps, unlimited liabilities, impossible requirements, and verify the completeness of the supplied technical information in consultation with SD. Check for anomalies and discrepancies in the tender documents and ensure consistency across all sections. Identify and prepare the most suitable pricing mechanism strictly as per the SOW. Review and track queries from Tenderers during the bidding phase. Review responses to technical queries prepared by SD and prepare responses to unpriced commercial queries, ensuring the quality and timely issuance of Tender Bulletins. Participate in mid-tender meetings, site visits, and face-to-face discussions with Tenderers. Address deviations to General Conditions of Contract, technical deviations, and unpriced commercial deviations, ensuring all issues are responded to through Tender Clarification. Ensure timely clarification of all issues in the Tenderers' Technical Proposals until the bids fully comply with Tender requirements. Prepare the Technical Evaluation Report for review by the evaluation committee. Lead the Commercial Evaluation. Analyse commercial proposals, prepare Commercial Tabulation and Evaluation Reports, convene meetings with the Commercial Evaluation Team, and ensure timely submission to the concerned Tenders Committee. Coordinate proactively with SD after Commercial Evaluation Report and Award Plan submission to obtain necessary inputs for the Letter of Acceptance of Tender and Award of Contract (LOA). Ensure timely issuance of LOA to the selected Tenderer. Initiate the review process of the draft Contract document, finalise it with input from other concerned Departments, and issue the Draft Contract for review and execution by the Contractor. Administer all change management processes, including reviewing and evaluating Users’ proposed changes and their contractual impact on the original Contract in terms of time and cost. Evaluate Contractor’s change proposals to ensure compliance with Contract terms and reasonableness of time and cost. Critically evaluate and challenge Contractor’s claims from both contractual and commercial perspectives. Ensure the close-out process is initiated by SD on time. Review Completion Certificates (CC), Statement of Final Accounts (SFA), Close-Out Reports (COR), and Discharge Certificates (DC). Identify global trends in materials supply to support the development of both short- and long-term sourcing strategies and risk mitigation plans. Participate in the creation of Service Level Agreements (SLA) and Key Performance Indicators (KPIs). Implement and analyse performance reports, and monitor key deliverables such as the administration of bonds and guarantees.
