Main responsibilities:

The Privacy Counsel, Advertising will play a key role within Albertsons’ privacy team. This position is responsible for mitigating risks and ensuring compliance with ethical and regulatory standards in advertising and marketing. Key focus areas include navigating various types of personal data, responsible data use, audience targeting, personalization, attribution, and measurement. 

Provide legal guidance on privacy and data protection laws impacting advertising technologies, digital marketing, and retail media networks, including programmatic advertising, pixels, cookies, and mobile identifiers. Support the review and negotiation of DPAs and privacy related terms with advertising partners, data providers, demand-side platforms (DSPs), supply-side platforms (SSPs), and other retail media stakeholders. Identify technical and functional requirements for go to market products that align with legal, regulatory, and contractual requirements and obligations. Advise product, media, and marketing teams on navigating data (personal data, consumer health data, protected health information, etc.), responsible data use, audience targeting, personalization, attribution, and measurement strategies in compliance with privacy regulations. Develop and operationalize privacy compliance strategies and processes for retail media networks, including data governance frameworks, consent mechanisms, and data sharing models. Monitor evolving laws and regulations and assess their impact on advertising and media operations. Collaborate with cross-functional teams, including retail media, enterprise marketing, data science, innovation, and IT, to embed privacy by design into data collection and media offerings. Train internal stakeholders on advertising and media-related privacy risks, policies, and procedures.

We are looking for candidates who possess the following:

JD degree and admission to at least one US state bar. 5+ years of legal experience, including in-house or law firm experience focusing on privacy, advertising, advertising technologies, or media law. Deep understanding of digital advertising ecosystems, including real-time bidding (RTBs), identity resolution, data clean rooms, cookie alternatives, and privacy-enhancing technologies (PETs). Strong knowledge of US privacy laws and privacy frameworks related to advertising and consumer data. Ability to understand data lifecycle through technology stacks and differentiate purpose specification throughout the environment. Experience advising on consent management, privacy notices, and transparency requirements in the ad tech context. Familiarity with retail media operations, including first-party data monetization, in-store to online attribution, and closed loop measurement. Demonstrated ability to translate legal requirements into practical, scalable solutions for business and product teams. Excellent communication, collaboration, and stakeholder management skills. CIPP/US, CIPP/E, CIPT, or CIPM certification preferred, but not required.

The position will be based in Pleasanton, CA or Boise, ID.

The salary range is $ 135,800 to $ 188,500 annually. Starting salary will vary based on criteria such as location, experience, and qualifications. There may be flexibility  for exceptional candidates. Benefits may include medical, dental, vision, disability and life insurance, sick pay (accrued based on hours worked), PTO/Vacation Pay (accrued based on hours worked)  or Flexible Time Off, paid holidays (8-9 days annually), bereavement pay, and retirement benefits (such as 401(k) eligibility).  Associates in this position are also eligible for a quarterly bonus.
