Job Summary
Manage compliance for goods movements, domestic and international, to and from the business locations of Avient Protective Materials in the United States of America. Providing leadership, direction and guidance on all topics relating to import and export, including Export Administration Regulations (EAR), International Trade in Arms regulations (ITAR), applicability of sanctions, embargoes and other tools of foreign policy. Developing compliance functions, and ensuring compliance by developing and maintaining policies, training, coaching and auditing.
Essential Functions
Responsible to develop, manage, maintain and communicate customs and trade compliance processes and procedures, for international movements of goods and technologies, including raw materials, finished goods, equipment and samples;
Responsible for management of customs brokers and forwarders, including management and administration of relevant authorizations;Responsible for managing activities by bonded and free-trade-zone facilities;Responsible for managing administrative duties associated with customs brokering, electronic export information filing (EEI), certificates of origin, end-user and/or assurance certificates, utilization of free trade agreements, determination of commodity codes, ECCN classification;Liaising with relevant US government organizations such as Customs and Border Patrol (CBP), Bureau of Industry and Security (BIS), Directorate of Defense Trade Controls (DDTC), Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to acquire rulings, commodity jurisdiction determinations, import and export licenses;Establish and execute external (i.e. brokers) and internal compliance audits for risk mitigation and continuous improvement, to identify potential compliance problems, perform investigations and develop appropriate policies and procedures in accordance with regulatory requirements;Continuously monitor developments in government trade policies and timely initiating action to assure continuing compliance with regulations;Develop and deliver education and training programs to personnel in regulatory requirements as related to specific tasks requiring specialized knowledge to ensure compliance;Work in an international compliance team with professional colleagues in the Americas, Europe and Asia;Develop, implement and maintain CTPAT compliance and certification;Develop, implement and maintain duty drawback programs;Audit compliance with record-keeping requirements related to international goods transactions at the different locations of DSM Protective Materials LLC in the USA;Responsible for compliance with relevant laws, company guidelines and requirements through adherence to company policies relating to quality, safety, housekeeping and cost effectiveness.Interact directly with the DSM Trade and Compliance director in relation to policy, procedures, compliance and auditing;Interact directly with DSM Legal Affairs in United States to respond to official government inquiries, inspections and investigations;Perform other duties as assigned.Comply with all job-related safety and other training requirements.
Authorities
Set policies and procedures to meet customs and trade compliance and streamline associated processes;Authorized representative by power of attorney of other DSM Protective Materials entities and locations in the USA, for matters relating to import and/or export of goods and technologies.Authorized to hold international export shipments in case of issues or concerns related to trade and/or customs compliance. Company representative for DSM Protective Materials LLC with U.S. Customs and Border Protection (CBP), Bureau of Industry and Security (BIS), Directorate ofDefense Trade Controls (DDTC) in relation to customs and global trade issues.Special Assignments
Optimize and maximize duty drawback on imported raw materials, exported products and waste;Improve processes for auditing import and export transactions internally and by brokers and forwarders;In collaboration with locations abroad, design, develop and roll-out processes for shipping technical goods.Education and Experience
BS/BA and 5 years of relevant experience or AA/AS and 6 years of relevant experience or HS Diploma with 10 years of relevant experienceRelevant experience in the manufacturing industry. Leadership or supervisory experience is a plus.Training and experience in customs brokering preferred;Excellent knowledge of US customs regulations;Excellent knowledge of import duty regulations and processes;Excellent knowledge of Export Administration Regulations (EAR) and International Trade in Arms regulations (ITAR)Affinity or experience with high-performance materials.At least 10 years of experience in import and export compliance;Experience working in a multinational organization;Experience with conducting internal and external audits in customs and compliance;Experience working with forwarders and customs brokersExperience with ECCN classification;Experience with HTSUS and Schedule B classification;Experience with SNAP-R and ACE;Excellent problem solving/troubleshooting skills
Complexity of the Job
This position requires a excellent understanding of US customs regulations and requirements, but also of the dynamics and implications of rapid changing international trade politics. In addition to this, Employee needs to have ability to understand technical properties of our raw materials, products and technologies for the purpose of EAR/ITAR classification.Employee needs to be able to translate complex laws and regulations into policies that are relevant for our business and understandable to functions in different professional and hierarchical levels of the organization.
Employee will be required to travel to other sites to audit or provide compliance training and assistance.
