Summary Join the dedicated appellate practitioners in the U.S. Immigration and Customs Enforcement (ICE) Office of the Principal Legal Advisor (OPLA) Immigration Law and Practice Division (ILPD) across the country and assist in shaping immigration law to protect our homeland. This position may offer up to $50,000 in signing and retention bonuses. Applicants should indicate their location(s) preference in their cover letter. Responsibilities OPLA is the largest legal program in the Department of Homeland Security (DHS), employing nearly 2,000 attorneys nationwide. OPLA provides a full range of legal services to all ICE programs and offices and serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review (EOIR). Selected attorneys will primarily serve as DHS's appellate counsel before the U.S. Immigration Courts and the Board of Immigration Appeals (BIA) of EOIR, U.S. Department of Justice (DOJ) in administrative removal cases brought by DHS agents and officers, including those against criminal aliens, terrorists, and human rights abusers. ILPD attorneys provide immigration law subject-matter expertise and appellate advocacy before the BIA, including the preparation of briefs, motions, and other pleadings. ILPD attorneys will: Zealously litigate on behalf of DHS, including advocating to maintain custody of dangerous aliens pending completion of removal proceedings, ensuring the proper application of criminal and other grounds of removability from the United States, and presenting arguments to defeat meritless claims for relief from removal and certain forms of protection (asylum, statutory withholding of removal, and the regulations implementing U.S. obligations under Article 3 of the Convention Against Torture). Represent ICE's interests in federal court litigation on novel or complex immigration law issues, regularly contribute to document review in federal civil discovery, and provide legal advice and support to the other ICE components and litigation support to United States Attorney's Offices in immigration or customs matters, as necessary. Work with other OPLA Headquarters divisions and OPLA field locations, DHS Office of the General Counsel Headquarters (OGC HQ), certain DOJ components, including the Office of Immigration Litigation (OIL), and other ICE and DHS personnel on a wide range of substantive issues related to immigration law. Selectees must possess the following knowledge, skills, and abilities, characteristics, and competencies: applicants must be adept at prioritizing multiple assignments, exercising sound legal and practical judgment, efficiently producing quality legal analyses of complex legal issues, and working effectively in a fast-paced environment. Applicants should also demonstrate the ability to take initiative and work in a reliable, decisive, and professional manner. Bar Membership: You must be an active member in good standing of the bar of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. Promotion Potential: This position has promotion potential to the GS-14. When promotion potential is shown, the agency is not making a commitment and is not obligated to provide future promotions to you if you are selected. Future promotions will be dependent on your ability to perform the duties at a higher level, the continuing need for an employee assigned to the higher level, and administrative approval. Bargaining Unit Status: This is a bargaining position. The exclusive representative for this bargaining unit position is the American Federation of Government Employees (AFGE), with representation provided by AFGE, Local 511. Direct Deposit: All federal employees are required to have Federal salary payments made by direct deposit to a financial institution of their choosing. Veterans' Preference: There is no formal rating system for applying veterans' preference to attorney appointments in the Excepted Service; however, OPLA considers veterans' preference eligibility as a positive factor in attorney hiring. Financial Disclosure: If you are hired, you may be required to complete a Confidential Financial Disclosure Report (OGE Form 450) within 30 days after appointment. Suitability: If you receive a conditional offer of employment, you must complete an Optional Form 306, Declaration for Federal Employment, and sign and certify the accuracy of all information in your application, prior to entry on duty. Background Investigation: DHS requires every employee to be reliable and trustworthy. To meet these standards, all selected applicants must undergo a background investigation and successfully obtain and maintain a security clearance at the Secret level as a condition of placement into this position. This may include a credit check, a review of financial issues such as delinquency in the payment of debts, child support and tax obligations, and a review of certain criminal offenses and illegal use or possession of drugs.
