About the role:
The Deputy Secretary – Justice Policy & Legal Services is responsible for ensuring that the functions of the Department under his or her responsibility are delivered in a manner consistent with and aimed at achieving the objectives of the Department’s Corporate Plan. The Deputy Secretary provides policy & legal advice and support services to the Secretary (DJLS) in relation to legislative and policy development, contracts and litigation, commercial, and international law. The Deputy Secretary – is responsible for the oversight and effective management and leadership (through the respective Directors) of the Policy and Legal Services Wing
Position Purpose The office of Deputy Secretary– Justice Policy & Legal Services is one of two (2) Deputy Secretary positions (the other being the Deputy Secretary- Policy & Legal Services) within the Department of Justice and Legal Services (the Department). The Deputy Secretary is responsible for ensuring that the functions of the Department under his or her responsibility are delivered in a manner consistent with, and aimed at achieving the objectives of, the Department's Corporate Plan. The Deputy Secretary provides policy & Legal advice and support services to the Secretary for Law and Justice in relation to legislative and Policy Development, contracts and litigation, commercial, and international law. The Deputy Secretary — Policy and Legal Services is responsible for the oversight and effective management and leadership (through the respective Directors) of the Policy and Legal Services Wing Accountabilities
The Deputy Secretary is accountable to the Secretary in terms of : Compliance with all lawful instructions issued by the Secretary; provision of timely reports to the Secretary in respect to the effective management of the activities and staff of the Policy and Legal Services Wing of the Department. Effective & efficient Management of the operations and core functions of the Policy and legal service Wing including financial & Asset Management and providing leadership to officers of the Directorate, to ensure the successful management and administration of its operations and functions; compliance with, and application and enforcement of the Code of Conduct and Ethical Behaviour of the Bougainville Public Service, and the staff performance management and disciplinary provisions of the Public Service Act; Provision of Policy legal support services to the Autonomous Bougainville Administration — including proactive monitoring of the legislative implementation of autonomy Provision of competent and professional advice on the core functions directly under his or her responsibility including legislative and Policy Development, contracts and litigation, commercial, and international law. The display of the highest ethical and professional standards in the delivery of legal services to the Autonomous Bougainville Government.
Major Duties Lead/Supervise a team of lawyers on the conduct of prosecution and defence matters on behalf of the ABG, Lead and manage the drafting of contracts, MOA and other legal documents and attend contract litigation and legislative development programs of the Autonomous Bougainville government. Provide legal advice on constitutional, administrative and international law matters, Advice and drafting and interpreting legislation. Draft Policies and/or provide legal advice and clearance of on major policies for and on behalf of the Bougainville Public Service Lead and manage the operations of the Policy & Legal Services Wing and represent the Secretary on matters of importance to the Department as and when directed by the Secretary or represent the Secretary on similar matters that the Secretary is unable to attend. performance of all other duties and responsibilities as may be set out elsewhere in this description, or in the Deputy Secretary's terms and conditions of appointment. Reporting and Working Relationships Internal Secretary Law and Justice Police, Corrective Services and Justice, the Minister Justice and Attorney General and other senior management officers of the Department. Work with other government divisions and agencies, including international organizations, donor contractors, stakeholder organizations, civil society, the business community, landowners, and the public as required.
Personnel and Job/Position Specification
Qualification Master's degree in law (or a String bachelor's degree) from a recognized university. Member of an appropriate and relevant professional body. Knowledge Extensive knowledge of the Bougainville constitution, legislative and regulatory framework Extensive knowledge of the Papua New Guinea Constitution and the arms of government (Legislative, Executive and Judiciary) the legal system of PNG, and the law making and law reform and policy process Knowledge of the Public Service Management & Administrative Act and General Orders, The Public finance Management & Administrative Act and Financial Manuals, the Bougainville Supply & Tenders Act and other relevant legislations Skills Proven ability to lead and manage a productive and effective team of professionals, with good inter-personal skills especially in developing and sustaining teamwork Exceptional oral and written communication skills, with proven capacity to draft high standard documents. Strong analytical and research ability with capacity to bring clarity to, and simplify, complex concepts or processes. High level of computing skills in most computer application software. Proven ability to act in Court and legislative settings
Work Experience Significant legal work experience at a senior level including leading and supervising staff and workload. At least 7 years or more dealing with legal or law related matters, with significant high-level experience within a law reform, international law or human rights environment.
