Qualifications (Typical):
Tertiary legal or equivalent qualification and relevant industry experience such as LLB (or similar) and/or QS/ Engineering qualifications. Particular knowledge of Construction Contract suites such as FIDIC, NEC, JBCC and GCC. Dispute resolution experience is preferred Other relevant post graduate qualifications, albeit technical, management or business related could be advantageous
Experience:
Extensive industry experience of 10 to 15 years in contracts and commercial management with Mining EPCM Projects. Proven leadership in managing complex EPS/EPC/EPCM projects and contract portfolios. Demonstrated experience in strategic negotiations and dispute resolution. Experience in mentoring and leading contract administration teams. Experience in negotiating commercial terms with Suppliers. Proficiency in drafting of bespoke agreements, NDA’s and credit applications.
Knowledge:
A thorough understanding of Mercantile and Contract Law. A proper grasp of contracts management principals. The end-to-end Supply Chain process. Good understanding of Engineering processes. Claim management proficiency. Financial acumen. PC Literacy. Understanding of negotiation principles.
Skills:
Self-starter, ability to work unsupervised. Results and delivery orientated. Organisational skills like planning and prioritizing ability. Team player with interpersonal motivational skills. Ability to interact at various levels ranging from shop floor level to company executives. Ability to produce accurate work. Ability to efficiently complete work in a high stressed environment. Excellent verbal and written communication skills.
RESPONSIBILITIES:
The incumbent will be responsible for:
Strategic commercial management of Suppliers and Sub-contractors Commercial liaison with Clients Oversight of Supplier cost control and risk mitigation strategies Leading negotiations and drafting of complex contractual agreements Approval and governance of contract amendments and change orders Development and enforcement of confidentiality and IP protection protocols High-level Supplier engagement and dispute resolution Oversight of claims management and resolution strategies Leadership in tender adjudications and commercial evaluations Review and approval of contractual documentation for compliance and risk Attending to commercial queries during tender stage Commercial and contractual compliance (Interaction with Suppliers regarding timely submission of required contractual documents such as Bonds, programs, quality documents) Assisting with tender adjudications Review credit applications Assessing and approving monthly claims from Suppliers for invoicing Claims management Drafting contractual letters Negotiating Advance Payment and Performance Bonds Reviewing Package Scope of Works and other contractual documents in order to check for commercial compliance.
