ActivitiesANTI-CORRUPTION / ANTI-TRUST COMPLIANCE
Implement in ATMI the Company’s Anti-corruption and Antitrust Compliance Programs and the Integrity Policy and Program, including the relevant directives, policies and procedures (hereafter the “Programs”).Implement the Programs within ATMI and monitor the effective respect of the same.In coordination with the Branch Compliance Officer and ATMI’s HR Division, participate in the promotion of training tools (including e-learning) and awareness-rising and training actions required by the Programs.Perform corruption risk analysis and due diligence.Maintain a secure and detailed archiving /document conservation system in accordance with the Company policies and procedures, particularly regarding due diligence.Liaise with other Compliance Officers of the Trading & Shipping Division when necessary to create a strong Compliance Officers network. Represent ATMI in external compliance initiatives when needed. Alert and update the Branch Compliance Officer of any incident of corruption, fraud or antitrust which comes to his/her attention in accordance with the relevant incident treatment procedures.Contribute to ensuring a robust culture of compliance with legal requirements within ATMI.Regular reporting to ATMI President & CEO and coordination with the Branch Compliance Officer.MARKET COMPLIANCE
Regulatory Compliance Controls – Work with Management, Risk Control, Trading and Legal to constantly improve the way market compliance is organized, and to maintain internal controls relating to trading and related activities. Coordinate with departments to develop, initiate, maintain, assess effectiveness and implement improvements for those internal controls.Applicable Financial Regulations – Ensure ATMI compliance with, and employee awareness of, Applicable Financial Regulations. Answer questions from Management, Trading and other personnel relating to applicability of Regulations to specific business activities. Act as the Market Compliance Officer for ATMI.Compliance Assessments - Ensure Proactive compliance of trading activity with applicable rules and regulations by relevant authorities as well as the internal policies of ATMI, the Division and the TotalEnergies Company. Internal Monitoring – Monitor ATMI and employee trading activities to ensure compliance with ATMI trading policies, including the Trading Compliance Code.Training – Periodically train ATMI staff on compliance requirements and DTS’s standards, policies and procedures related to trading compliance.Culture of Compliance – Contribute to ensuring a robust culture of compliance with legal requirements.Follow compliance indicators.Regular reporting to ATMI President & CEO and coordination with Market Compliance officers in Geneva.PURPOSES
Compliance with all applicable regulations and rules regarding the trading activities of ATMI.Submission of periodic compliance reports to senior management.Maintenance of all required compliance documentation on a current basis.Effective and efficient management of regulatory and other external inquiries and investigations regarding trading activities from a compliance perspective.Achievement and maintenance of a high level of knowledge and awareness of regulatory and compliance requirements by Trading, management and other ATMI staff. Candidate ProfileYou are someone who possesses the following experience and credentials:
Education/Experience:
Ability to understand rules covering Trading activities, including NYMEX, ICE, FCA and CFTC rules and regulations, with particular emphasis on compliance and control.7-10 years experience in trading markets or compliance matters.Ability to understand and synthesize complex legal and regulatory concepts and translate for business stakeholders. Good understanding of the trading business, particularly in the financial commodities markets (including futures, options and swaps).Skills
Excellent oral, presentation and written communication skills with the ability to apply these skills at all levels of the organization.Strong interpersonal skills, including ability to adopt a variety of teambuilding and communication approaches to achieve desired results.Strong work ethic and ability to work creatively to achieve identified goals.Strong problem-solving skills with ability to see the next step and follow through on operational detail.Demonstrate the ability to build consensus with diverse stakeholders.
